The French Anti-Corruption Agency (AFA) publishes its annual report and key figures for its 2019 activity

The AFA published its 2019 annual activity report on July 9. The report details the key figures of AFA's activity last year, and specifies the lessons to be learned. 



The AFA published its 2019 annual activity report on July 9. The report details the key figures of AFA's activity last year, and specifies the lessons to be learned. 

The annual report first of all gives several figures relating to the agency's activity: 

  • The AFA has increased its consulting activities:

  • 3 guides have been published;

  • 50 training activities have been set up; 

  • The AFA's control activity has also continued to develop: in 2019, the AFA initiated 36 controls, including : 

    • 3 global audits of CAC 40 companies; 

    • 12 thematic audits of companies in targeted business sectors; 

    • 5 audits following warnings on entities controlled in 2017 and 2018; 

    • 16 audits of public-sector entities; 

    • 4 audits on the execution of legal agreements in the public interest; 

  • The Sanction Commission was first seized in 2019.

The AFA's international activity also continued to expand in 2019: 

  • The AFA was elected in 2019 to the presidency of the Network of Corruption Prevention Authorities (NCPA); 

  • AFA's coordination with three judicial authorities was consolidated (the British Serious Fraud Office (SFO), the American Department of Justice (DoJ) and the French Parquet National Financier (PNF)).

Finally, the AFA draws several lessons from its 2019 activity: 

  • The commitment of the governing bodies remains insufficient, although it is progressing; 

  • Among the pillars of the Sapin II law, the AFA notes that the companies' methodology is still too approximate regarding risk mapping. On the contrary, other pillars such as the code of conduct or the internal alert mechanism seem easier to implement; 

  • The AFA notes that the breaches it finds rarely concern a total absence of measures or procedures: the AFA notes more non-compliance or failure to deploy measures or procedures; 

  • The AFA's audits have been extremely effective: in the two audits completed in 2019, the AFA found that the audited entities had committed to implementing the AFA's recommendations, thereby removing all the shortcomings noted at the time of the audit.
